5. ORDER ACCEPTANCE / AVAILABILITY / PRICING

All orders are subject to review, availability, freight feasibility, verification, supplier confirmation, and acceptance by FiresideLuxe. FiresideLuxe shall not be liable for delays caused by freight carriers, weather, supplier production schedules, backorders, labor interruptions, routing issues, access limitations, force majeure events, or any condition outside FiresideLuxe’s reasonable control.

Customers are responsible for ensuring that the delivery address is accurate and that the location is accessible for the type of shipment ordered. Additional freight charges, redelivery charges, storage charges, liftgate fees, restricted-access fees, rerouting fees, or return freight charges caused by customer error or site inaccessibility are the responsibility of the customer.

8. DELIVERY INSPECTION / DAMAGE CLAIMS

Customers must inspect all shipments immediately upon delivery and before installation, assembly, modification, or use.

If there is visible shipping damage, packaging damage, shortage, or suspected freight damage at delivery, the customer must note it clearly with the carrier at the time of delivery and notify FiresideLuxe immediately.

If concealed damage is discovered after delivery, the customer must notify FiresideLuxe in writing within 48 hours of delivery and retain all packaging, pallet materials, packing materials, product materials, and delivery documentation.

Failure to inspect the shipment promptly, note visible damage at delivery, preserve packaging, provide photo documentation, or report concealed damage within 48 hours of delivery may reduce or eliminate FiresideLuxe’s ability to assist and may result in denial or limitation of any claim, replacement, refund, return authorization, or other requested remedy.

Products must not be installed, assembled, modified, or used if damage is suspected.

FiresideLuxe is not the carrier and is not automatically responsible for damage caused in transit. Where timely and proper notice is given, FiresideLuxe may, in its sole discretion, assist the customer by pursuing a carrier and/or supplier claim and determining the appropriate remedy.

If FiresideLuxe confirms verified transit damage that was not caused by the customer and determines that return shipment is required, FiresideLuxe will arrange, approve, or instruct the return or pickup method. FiresideLuxe is not responsible for unauthorized return shipments, self-arranged freight charges, or return shipping costs incurred without prior written approval.

If damage results from customer handling, improper storage, improper installation, job-site conditions, weather exposure after delivery, misuse, neglect, alteration, or failure to follow manufacturer instructions, all resulting shipping, pickup, replacement, repair, and related costs shall be the customer’s responsibility.

9. RETURNS / CANCELLATIONS / SPECIAL ORDERS

Because many FiresideLuxe products are special-order, oversized, freight-based, finish-sensitive, vendor-controlled, or ordered specifically for the customer, not all items are eligible for cancellation or return.

Unless expressly stated otherwise in writing:

• Special-order items may be final sale
• Custom items may be final sale
• Made-to-order items may be final sale
• Used, installed, assembled, altered, or damaged items are not eligible for return
• Return requests require prior written authorization from FiresideLuxe
• Unauthorized returns may be refused
• Original shipping charges are non-refundable unless required by law
• Return freight, restocking fees, processing fees, and related charges may apply

Orders that have already entered production, vendor processing, freight booking, or shipment may not be cancelable.
